These Customer Terms of Service ( Terms ) are a legal
agreement between you and Charmonix, carrying on
business as LuminPay ( LuminPay,
we, us or our ). They govern your personal use of luminpay.charmonix.ca, related
customer pages and the LuminPay marketplace,
membership, credits, booking-request and account
services (collectively, the Platform ).
Please read these Terms before creating an account or
paying. Important recurring-price, cancellation, credit and clinic information
appears near the beginning because it should not be hidden in fine print.
IMPORTANT
The $1 charge is a paid 30-day introductory period, not a
free trial. After 30 days, your selected pass renews automatically every month
at $49 for Starter or $89 for Pro, plus applicable tax, until you cancel. Your
exact first renewal date and each periodic amount must be shown before you pay.
1. Who we are and how to contact us

The full legal entity, address, working contact methods and
any legally required registration or licence information must also appear at
checkout and on the contract receipt.
2. Eligibility and personal use
You may use the Platform only if you:
are at least 18 years old;
have legal capacity to enter a contract;
are using the Platform primarily for personal, family or
household purposes;
are located in a region that LuminPay currently serves; and
provide accurate account and payment information.
The launch service area is Calgary, Alberta, unless the
Platform expressly identifies another approved area. You may not create an
account for a minor, resell credits or use a consumer account for a clinic,
ambassador, employer or other commercial purpose.
3. LuminPay is a marketplace, not
a clinic
LuminPay administers a marketplace
membership, credits, payment status and booking requests. LuminPay
is not a medical clinic, health professional, pharmacy, insurer or emergency
service. We do not diagnose, prescribe, recommend treatment, decide whether a
procedure is suitable, set clinical units or doses, obtain clinical consent,
perform a procedure or guarantee a clinical result.
Participating clinics and their regulated professionals are
independent from LuminPay. The clinic alone decides
assessment, eligibility, contraindications, treatment, units or dosage,
clinical pricing, consent, scheduling, aftercare and outcome. A clinic may
decline or change a proposed service for clinical or lawful reasons. Your
clinical relationship is with the clinic and is governed by the clinic s own
patient terms, consent documents, cancellation rules and privacy notice.
Do not use LuminPay for
emergencies or urgent medical concerns. Contact 911 or an appropriate health
professional.
4. The current membership offer
All amounts are in Canadian dollars. Applicable government
taxes may be added. No other mandatory fee may be added unless it is clearly
included in the total before you agree.

The checkout must show your selected plan, amount due now,
applicable tax, exact first renewal date, recurring amount and frequency,
credits issued after each verified payment, cancellation route and any material
restrictions before you pay. If the checkout conflicts with this table, do not
continue and contact support.
The current contract acknowledgement is:

beginning 30 days after I complete secure checkout, then monthly until I
cancel.
That acknowledgement must be a separate, unchecked control.
Optional email marketing and optional SMS marketing must use their own
separate, unchecked controls. You may buy without agreeing to marketing.
5. Forming the online contract
Before you place an order, LuminPay
will give you a reasonable opportunity to review, correct and accept or decline
the transaction. The checkout summary will identify the supplier; describe the
membership and credits; itemize the price, taxes and other charges; state the
total and recurring amounts in Canadian dollars; state timing; explain
cancellation, refunds and restrictions; and link to these Terms and the Privacy
Policy.
You enter the contract only when you deliberately select the
final purchase button after completing the required acknowledgement and the
payment provider accepts the transaction for processing. A return page alone
does not prove payment. Credits and activation occur only after LuminPay verifies the provider s authenticated payment
event.
We will promptly email or make available in your account a
contract receipt that includes your name, contract date, supplier identity and
contact information, selected pass, amount paid, taxes, exact renewal date and
cadence, cancellation route, material restrictions and the version of the Terms
you accepted. Save that receipt.
Nothing in these Terms limits a cancellation, refund,
disclosure, chargeback or other remedy that applicable consumer law gives you.
5.1 Alberta internet-contract rights
Where Alberta s Internet Sales Contract Regulation applies,
you may have additional cancellation rights if required pre-contract
information or the opportunity to correct errors was not provided, if you do
not receive a required copy of the contract within the legal period, or if the
contracted service is not started by the required date. Depending on the
failure, the cancellation period may include seven days after receiving the
contract or 30 days after entering it. A valid statutory cancellation may require
LuminPay to refund all consideration within 15 days.
These rights operate in addition to, and are not narrowed by, LuminPay s ordinary cancellation policy. Contact support or
Service Alberta for help with a specific situation.
6. Your account and security
You are responsible for accurate information and reasonable
protection of your sign-in method. Tell us promptly if you believe your account
or payment method has been used without authorization. Do not share one-time
passwords, authentication links or account access.
One person may hold one customer account and receive one
introductory offer. We may use privacy-minimized fraud signals to identify
duplicate introductory offers. We will not store a card number or raw payment
fingerprint for this purpose. If an apparently duplicate attempt is detected,
we may pause it for human review or cancel and refund the duplicate
introductory charge; we will not silently convert it into an undisclosed
full-price purchase.
7. Recurring payments and payment processing
By purchasing a pass, you authorize LuminPay
and its payment processor to charge the payment method you provide for:
the $1.00 introductory charge and applicable tax;
the selected monthly renewal price and applicable tax
beginning on the displayed date; and
any separate purchase you later and expressly approve.
Stripe currently hosts the card checkout and stores payment
credentials. LuminPay is not intended to receive or
store your full card number or card security code. Stripe s own terms and
privacy notice also apply to its services.
If a renewal payment fails, we may provide notice and make
reasonable, disclosed retry attempts. We do not issue new monthly credits until
payment is verified. We will not add an undisclosed late fee. Existing valid
paid credits are not erased merely because a later renewal fails.
We may change a future plan price,
credit amount or material term only prospectively, with clear advance notice
and any express consent required by law. A price increase is never applied
retroactively. You may cancel before the change takes effect.
8. Credits
8.1 What credits are
Credits are contractual accounting units used only for
eligible services offered through the LuminPay
marketplace. For display and redemption administration, one credit currently
has a reference value of $12.25 CAD. A credit is not cash, legal tender, a
deposit account, a bank product, an investment, insured value or a claim to
interest. Credits are personal, non-transferable, not withdrawable and may not
be sold, pledged or exchanged for cash except where law requires a refund.
8.2 When credits are issued
Credits are issued only after LuminPay
verifies a successful payment. The introductory payment issues 0.83 credit.
Each successful Starter renewal issues 4.00 credits. Each successful Pro
renewal issues 8.00 credits. A pending authorization, checkout return page or
unverified message does not issue credits.
8.3 Expiry and inactivity
Under the current policy, credits issued after a verified
payment including the 0.83 introductory credit do not expire, and no inactivity
fee applies. Cancelling a membership stops future renewals and future monthly
credit issuance; it does not erase unused valid credits or transaction history.
If LuminPay later offers a
genuinely free promotional credit with an expiry or special restriction, the
restriction will be clearly disclosed before you accept that promotion, will
apply only prospectively and will not change existing paid credits. LuminPay will not silently reclassify a paid credit as
promotional.
8.4 Booking-request threshold
You need at least 20.00 available credits to unlock a
treatment booking request. Reaching 20 credits does not guarantee an
appointment, clinical suitability, a particular service, a
number of units, a clinic price or an outcome. Credits required for a
proposed service and any separate clinic charges must be shown before you
commit.
8.5 Reservation, use and release
When you make a booking request, the applicable credits may
be reserved so they cannot be used twice. Reserved credits are not consumed
merely because you asked for an appointment. They are consumed only after the
authorized service outcome is verified under LuminPay s
ledger rules. If a clinic declines the request, the request expires, the
service is not provided or the clinic cancels, reserved credits will be
released unless a different, lawful and separately accepted rule applies.
No clinic cancellation, no-show or late-change rule may
consume credits unless that exact rule and consequence were shown to you before
you confirmed the appointment. A clinical dispute does not authorize LuminPay to rewrite ledger history without evidence and
human review.
8.6 Corrections, refunds and reversals
If a payment is reversed, refunded or successfully disputed,
LuminPay may reverse only the unused credits funded
by that payment. Reserved or already consumed credits require human review; we
will not create a hidden negative balance or silently delete ledger entries.
Fraud, duplicate payment and manifest error may be corrected through an
auditable adjustment, subject to applicable law.
If LuminPay permanently
discontinues the consumer marketplace or closes your account without cause, we
will provide a reasonable redemption period or refund the amount attributable
to unused paid credits, subject to applicable law. Free promotional credits are
not cash-refundable unless law requires otherwise.
9. Optional Affirm top-up
If LuminPay expressly makes it
available, an optional $235.00 CAD top-up may add 19.17 credits after Affirm
separately approves and captures the transaction. Combined with the 0.83
introductory credit, that would make 20.00 credits. The top-up is not active
unless it appears as an approved option in your account.
Affirm, not LuminPay, decides
credit approval and financing terms. Review Affirm s
cost-of-borrowing disclosure, payment schedule, terms and privacy notice before
accepting. Membership cancellation does not cancel an Affirm financing
agreement. Credits are not issued on an authorization alone; they are issued
only after capture is verified. Refunds and adjustments must follow both LuminPay s ledger controls and the applicable Affirm
process.
10. Booking requests and clinic communication
You choose whether to send a booking request to a
participating clinic. Before any clinic receives your information, the Platform
will identify the clinic, explain the information to be shared and ask for the
required authorization.
For scheduling, LuminPay may offer
a temporary masked telephone connection. If you consent, a Twilio-powered
number connects you and the matched clinic for no more than 72 hours from
activation. LuminPay does not record audio, create
transcripts, analyze voice content or create voiceprints. You may withdraw
permission and close the connection sooner. If the masking service is
unavailable, we will not silently expose your private number.
Do not send diagnosis, photographs, medical records,
medication lists, symptoms or other clinical information through general LuminPay support, marketing forms or the masked scheduling
connection. Provide clinical information only through a clinic s approved
patient process.
11. Cancelling your pass
You may cancel at any time through Account → Billing
→ Manage or cancel pass, or by contacting support at hello@charmonix.ca
if the self-service route is unavailable. The account must show your next
renewal date and provide a cancellation confirmation. Keep the confirmation.
Unless law requires a different result, cancellation takes
effect at the end of the already-paid billing period and prevents the next
renewal. No new monthly credits are issued after cancellation. Your unused
valid paid credits remain in your account and do not expire under the current
policy. Any existing booking or reserved-credit issue will be resolved under
the rule disclosed for that booking.
Deleting an account is different from cancelling a
subscription. A deletion request does not replace cancellation unless we
confirm that it also stopped billing. We retain limited ledger and contract
evidence as described in the Privacy Policy even after cancellation or account
closure.
12. Refunds, payment errors and statutory remedies
Except where these Terms, a displayed offer or applicable
law provides otherwise, membership and separately approved top-up payments are
final after the corresponding credits are issued. This does not limit remedies
for an unauthorized or duplicate charge, missing mandatory disclosure, unfair
practice, failure to provide the contracted Platform service or another legal
right.
Contact hello@charmonix.ca promptly with the receipt number
and the amount in dispute. Never send a full card number or card security code.
Approved refunds return to the original payment method where practicable and
trigger the corresponding unused-credit reversal. Provider and bank processing
times may apply.
Clinical-service refunds, adverse outcomes and patient-care
disputes are primarily matters between you and the independent clinic under the
clinic s agreement and professional obligations. LuminPay
will nevertheless investigate and correct its own payment, booking or credit
records when given reliable evidence.
13. Service and marketing communications
We may send factual messages needed to provide the service
you requested, including sign-in codes, receipts, security alerts, renewal and
cancellation notices, payment failures, booking status and support replies.
These are service messages, not permission to send unrelated advertising.
Email and SMS marketing are optional and require a separate
consent or another lawful basis. Each commercial electronic message will
identify the sender and include a working unsubscribe method. We will process
an unsubscribe promptly and no later than the period required by law.
Withdrawing marketing consent does not cancel your pass and does not stop
necessary service messages.
14. Referrals, QR codes and paid relationships
LuminPay may use field
representatives, ambassadors or referral partners. A person promoting LuminPay may have a paid relationship with us. That
relationship must be clearly disclosed. Scanning a LuminPay
QR code is free and does not require a purchase.
With your optional cookie choice, an opaque referral or
campaign identifier may be retained for attribution. Attribution does not
change your price. Representatives and ambassadors must not receive your name,
contact details, treatment interest, payment status, cancellation reason or
clinic information; they receive only limited pseudonymous or aggregated
performance information.
Any contest or giveaway will be governed by separate
Official Rules. No contest is active merely because old or draft material
mentions one.
15. Privacy and cookies
Our Customer Privacy Policy explains how we handle personal
information. Our Cookie Policy explains cookies, local storage and optional
analytics or attribution. Privacy consent, cookie preferences, the required
contract acknowledgement and optional marketing consents are separate choices.
16. Acceptable use
You must not:
impersonate another person or misrepresent eligibility,
identity, payment authority or referral source;
create duplicate accounts or manipulate the introductory
offer;
sell, transfer, counterfeit, automate, scrape or tamper with
credits, QR codes, booking requests, receipts or ledger information;
bypass access controls, probe vulnerabilities, upload
malicious code or interfere with the Platform;
use the Platform to harass a clinic, customer,
representative or employee;
submit unlawful, deceptive or infringing content; or
use the Platform to obtain or provide clinical services
outside lawful clinic processes.
Reasonable security research must be reported to
hello@charmonix.ca and may not involve accessing another person s data,
disrupting service or exploiting a vulnerability.
17. Suspension and termination
We may restrict or suspend access when reasonably necessary
to address fraud, security, unlawful use, payment reversal, threat, material
breach or legal obligation. Where safe and lawful, we will give notice, explain
the general reason and provide a way to seek human review.
Suspension does not allow LuminPay
to confiscate valid paid credits. We may restrict redemption only to the extent
reasonably connected to the investigation or required by law. If we terminate
without customer fault, the discontinuance protection in section 8.6 applies.
18. Changes to the Platform or these Terms
We may improve or change the Platform. We will not
retroactively reduce valid paid credits, impose an expiry on existing paid
credits or change a completed transaction. If a material change affects
recurring price, credit issuance, cancellation, data use or another important
right, we will give clear advance notice and obtain express consent where
required. The Last updated date and version will change.
Your continued use after a non-material change may indicate
acceptance only to the extent permitted by law. If you do not accept a material
prospective change, you may cancel before it takes effect and retain the rights
attached to existing paid credits.
19. Intellectual property and feedback
LuminPay and its licensors own the
Platform, software, branding and content, except for content owned by clinics,
providers or users. We grant you a limited, revocable, non-transferable licence
to use the Platform for its intended personal purpose while these Terms apply.
If you voluntarily send product feedback, you allow us to
use it without payment or confidentiality obligation, but this does not
transfer ownership of your personal information, medical information,
photographs or support content. Public reviews remain yours and may not be
contractually prohibited where consumer law protects that right.
20. Disclaimers
To the extent permitted by law, the Platform is provided on
an as available basis. We do not promise uninterrupted availability, a
particular clinic, appointment, procedure, number of units, clinical
suitability or outcome. Information on the Platform is general marketplace
information and not medical advice.
These disclaimers do not exclude an express promise in your
checkout receipt, our obligation to administer verified payments and credits
with reasonable care, or any warranty, condition, right or remedy that law does
not allow us to exclude.
21. Limits of liability
Nothing in these Terms excludes or limits liability that
cannot lawfully be excluded, including liability for fraud or fraudulent
misrepresentation, wilful misconduct, or death or personal injury caused by LuminPay s negligence. Nothing limits your rights under
applicable consumer or privacy law.
To the extent permitted by law, LuminPay
is not liable for indirect, incidental, special or consequential loss that was
not reasonably foreseeable when the contract was formed. For a claim arising
solely from LuminPay s Platform service, our
aggregate liability will not exceed the greater of $100 CAD and the amount you
paid directly to LuminPay during the 12 months before
the event giving rise to the claim. This cap does not apply where law prohibits
it or to LuminPay s breach of confidentiality,
privacy or security obligations where a different remedy is required by law.
Clinics remain responsible for their independent clinical
acts, omissions and professional obligations. Payment, hosting, communications
and financing providers remain responsible under their own terms. This
allocation does not excuse LuminPay from
responsibility for choosing and overseeing service providers as required by
law.
22. Disputes and governing law
Please contact hello@charmonix.ca first so we can try to
resolve a concern promptly. If unresolved, either party may propose mediation.
Arbitration is available only if you voluntarily agree after a dispute arises
or otherwise choose it in a manner permitted by applicable law.
These Terms are governed by the laws of Alberta and the
federal laws of Canada applicable there, without depriving you of mandatory
rights in your home jurisdiction. Subject to those rights, disputes may be
brought in the courts of Alberta. These Terms do not require you to arbitrate,
waive a class proceeding or give up access to a court or regulator.
You may also contact Service Alberta s Consumer Contact
Centre, the Office of the Information and Privacy Commissioner of Alberta, the
Office of the Privacy Commissioner of Canada, the CRTC or another authority
with jurisdiction.
23. General terms
If a provision is unlawful or unenforceable, it will be
limited or severed only to the minimum necessary; the rest remains in effect. A
delay in enforcing a right is not a waiver. We may assign these Terms as part
of a genuine reorganization, financing or sale if the assignee assumes our
obligations and your mandatory rights are preserved. You may not transfer your
account or credits.
The order summary and receipt control the
transaction-specific price, renewal date and selected pass. These Terms control
general Platform use. A separately accepted booking rule controls that booking
only. A clinic s patient agreement controls clinical care. The Privacy Policy
governs personal information. Separate Official Rules govern a contest. If
there is a conflict, mandatory law prevails.
Electronic records and signatures may be used to form and
evidence this agreement. You may request an accessible copy from
hello@charmonix.ca.
